Chapter 1:　General Provisions

Article 1 (Purpose)

The following agreement is to regulate all services provided by the Globalization of Korean Food website, such as: conditions of usage, procedures, rights of the users and the Globalization of Korean Food website, obligations, responsibilities and other necessary services.

Article 2 (The Validity and Changes of the Agreement)

• 1. Once the user agrees to the terms and conditions of this agreement, this agreement has priority over all the services and actions provided by the Globalization of Korean Food website, and used by the user.
• 2. The Globalization of Korean Food website can change this agreement without notice. However, if such changes are made, the changes must be posted on the website or the users must be notified via e-mail. Once this notice is done, the validity of the changes comes into effect.
• 3. If the users do not agree to the changed terms and conditions, he/she can cancel her membership (cancellation). However, if they continue to use the website, it will be considered the users have agreed to the changes.
• 4. Any conditions that are not listed on this agreement will follow in accordance with the Telecommunications Act, Telecommunications Business Act, the review regulations of the Korean Internet Safety Commission, the ethics code of information communication, Program Protection Act and other related laws and regulations.

Article 3 (Definition of Terms)

The definitions of the terms used in this agreement is as follows.

• 1. User : The person who is provided the services of the Globalization of Korean Food website.
• 2. Register : The action in which one completes the request forms provided by the Globalization of Korean Food website and agrees to the terms and conditions of this agreement.
• 3. Member : The person who registers, provides the Globalization of Korean Food website with personal information and uses the services provided by the Globalization of Korean Food website.
• 4. ID : A combination of letters and numbers, provided by the website, so that the users can be identified and use the services.
• 5. Password : A combination of letters and numbers, selected by the user, to confirm the user and the member ID. Also, it is protection of privacy when communicating.
• 6. Cancellation : The action where the user terminates the contract.

Article 4 (The Establishment of Contract and Termination)

• 1. The contract is established if the user fills out the necessary blanks in a small online register form that is provided by the Globalization of Korean Food website.
• 2. The Globalization of Korean Food website can cancel the registration if the user registers under the following clauses.
  • 1) The user registered with another person’s identification.
  • 2) The register form of the contract had false information.
  • 3) Interrupts other users that use the services on the Globalization of Korean Food website or abuses information.
  • 4) Disregards the regulations provided by the Globalization of Korean Food website
  • 5) When other requirements, set by the Globalization of Korean Food website, are not followed.

Article 5 (Agreement to use Membership Information)

• 1. The personal information of members are protected by the Personal Information Protection Act of governmental organizations.
• 2. The membership information of the Globalization of Korean Food website is protected, used, and managed as follows.
  • 1) The Use of Personal Information : The Globalization of Korean Food website cannot reveal or distribute, any personal information, to a third party, without the member’s consent. However, by the Basic Electronic Communications Act, if a governmental organization, the Korean Internet Safety Commission, or any other organization, listed in the related act, requests such information, for the purpose of criminal investigation, the Globalization of Korean Food website must personally reveal the information.
  • 2) Management of Personal Information : The users can delete or edit any personal information, at any time, to protect and manage one’s information.
  • 3) Protection of Personal Information : The personal information of the users can only be seen/changed/deleted by the user themselves. The personal information is being managed by the user’s ID and password. As a result, the users must not reveal their ID or password to a third party and always log out afterwards.
• 3. According to the terms and conditions of this agreement, once the users request the services of the Globalization of Korean Food website, by filling in the request form, they agree on collection and usage of membership information.

Article 6 (Security of User Information)

• 1. As soon as the procedure of registration to the Globalization of Korean Food website is completed, the user is responsible for the information privacy entered on the website as well as all activities resulting from the use of their ID and password.
• 2. The user is responsible for all management responsibilities with their ID and password. If they find out that their ID and password are being abused by someone else, they must report it immediately to the Globalization of Korean Food website. The user is responsible for Everything that results from not reporting the abuse.
• 3. The user must log out of the service, once they are done with the use of the Korean Food website. The user will be responsible for anything that happens due to not logging out properly, such as the misuse of information by a third party.

Article 7 (Termination of Service)

• 1. The Globalization of Korean Food website can limit or terminate the rights of a user, without giving them notice, if they do not abide to the regulations mentioned on this agreement.
• 2. The Globalization of Korean Food website may terminate a user, due to disk disabilities, system failure, and other causes not intended by the system manager. If this is done, the website will not be able to notify the user’s of their termination. Also, the website does not notify any termination that occurs by communication companies, or telecommunications companies.
• 3. Emergency system inspection, addition, and substitution can lead to a temporary service shut down. This may happen without prior notice, due to unexpected happenings, and the website can terminate any current services, if they believe they have reason to provide other services.
• 4. A national emergency crisis, disabilities with service installation and the sudden increase of information trafficking may restrict the website of providing services smoothly. As a results, the website can restrict and limit some services. However, they must notify the users the reason and duration of the restrictions, either prior of after the restrictions are put in effect.

Article 8 (Change of services and Cancellation)

• 1. The Globalization of Korean Food website is not responsible for the losses that might occur due to the use of services and documents obtained from the website. The website is also not responsible for the validity, precision, and other factors of information and resources on the website.
• 2. Any losses that might occur on behalf of the user’s clumsiness or mistake will not be the responsibility of the Globalization of Korean Food website.

Article 9 (Copyrights of Posts on website)

• 1. The user has the rights of the posts that he/she has posted on the website.
• 2. The Globalization of Korean Food website has the right to edit, move, or delete posts, without prior notice, by the regulations on posting boards.
• 3. The user is responsible for all civil and criminal justice if his/her posting infringes upon other copyrights.

Article 10 (Obligations of the Globalization of Korean Food website)

The Globalization of Korean Food website will not reveal or disseminate the personal information provided by the users without their consent. However, if related governmental organizations, under the right of the Electronic Communications Related Act, and other regulations, requests such information, the information will be provided.

Article 11 (Obligations of the Users)

• 1. The users cannot use the services of the website, without their consent, for the gains of profit.
• 2. The information requested by the website, when registering as a member, must be filled in accurately. Also, the information must be updated frequently to accurately portray the status of the member. The user must not let a third party use his/her ID and password.
• 3. The members, when using the services of the website, must not conduct any of the actions listed in the below clauses.
  • 1) Abuse the ID and password of other members.
  • 2) Send, post, or e-mail any vulgar, obscene, provocative, insulting, threatening posts, that might infringe on the privacy of others.
  • 3) Hide or change the origins of the published posts.
  • 4) Send, post, or e-mail any posts that may not be posted by regulations and contract.
  • 5) Send, post, or e-mail any posts that might infringe upon the patents, licenses, confidential business information, and other intellectual property rights of other people.
  • 6) Send, post, or e-mail advertisements, promotional materials, spam mails, chain letters, and other promotional messages that are not authorized by the website.
  • 7) Collect or save personal information of other users.
  • 8) Any action that might be used or related to criminal activities.
  • 9) Any action that might damage the good customs, and other social orders.
  • 10) Insult or damage a third party’s honor.
  • 11) Infringe the intellectual property rights or other rights of others
  • 12) Hack or spread computer viruses.
  • 13) Repeatedly send advertising information or contents that are not desired by others.
  • 14) Any action that might create disruptions to the safe management of services.
  • 15) Edit information that is posted on the website.
  • 16) Other actions that are listed in article 53, clause 1, of the Electronic Communications Business Act and article 16 (dangers communication) of the enforcement ordinance of the Electronic Communications Business Act.

Article 12 (Prohibition of Transfer)

The members cannot transfer or lend any management rights, or any other rights listed in this contract, to use the services of the website.

Article 13 (Compensation of Losses)

The Globalization of Korean Food website is a free service. As a result, the website is not responsible for any losses that a member might experience, except for losses that occur due to the negligence of the website.

Article 14 (Exemption Clauses)

• 1. The website is not held responsible if it cannot provide the necessary services due to natural disasters, war and other uncontrollable factors.
• 2. The website is not responsible for the losses that might occur due to the repair, substitution, and regular inspection of services.
• 3. The website is not responsible if losses occur due to the malfunction of the user’s competer. Also, the website is not responsible for losses that might occur due to inaccurate filling of information such as: the member’s e-mail address or personal information.
• 4. The Globalization of Korean Food website cannot agree, disagree, or edit the opinions of its members and third parties. The Globalization of Korean Food website has no responsibility over the profits, or losses, of members that use the information provided by the service.
• 5. The Globalization of Korean Food website is not responsible for any trade that might happen over the website between members or a member with a third party. Also, the website lays no responsibility on the users who gain any profit by such trade.
• 6. The Globalization of Korean Food website is not responsible for any losses that might occur due to your negligence, or ignorance.

Article 15 (Jurisdiction)

The Globalization of Korean Food website follows the laws of the Republic of Korea, and thus, any dispute that might occur between the website and its users must be applied to the Department of Justice in the Republic of Korea.

Supplementary Provisions

1. (Effective Date) This agreement is effective from November 15th, 2007.
